Deed Recording Requirements
The Recording Department is the central depository for all documents recorded in the Official Record Books of Osceola County as required by Florida Statute. These records include, but are not limited to deeds, mortgages, assignments, satisfactions, subdivision plats, deed restrictions, agreements, claims of lien, notices, tax warrants, final judgments and other instruments relating to the ownership, transfer, encumbrance of or claims against real property or any interest in it. Other instruments that are recorded include declarations of domicile, certain court records, military service discharge and federal instruments. This division is also responsible for collection of state documentary and intangible taxes on certain documents such as deeds and mortgages. All records are microfilmed for future retrieval. The public is welcome to visit and perform research with our assistance or independently. Copies may be obtained by mail or in person.

Our office is open Monday - Friday from 8:30 a.m. - 5:00 .m. We stop recording at 4:00 p.m. Documents received after 4:00 p.m. will be recorded the next business day.
2. What are the recording fees?
The recording fee for any document up to 8 1/2 x 14: is $10.00 for the first page and $8.50 for each additional page of the same document. For documents with more than four names, there is an indexing fee of $1.00 per each additional name (this includes aka, attorney in fact, etc. ) On documents requiring book/page information, there is an additional fee of $1.00 per insertion.
State documentary stamps are figured at .70 cents per hundred or fraction thereof for deeds and .35 cents per hundred or fraction thereof on mortgages. Intangible tax is figured at .002 cents per hundred on actual amount.
3. What are the recording requirements for deeds?
PER FLORIDA STATUTES:
The signature of the grantor(s) must be notarized with the name and
address printed below each signature. The notary's name must also be
printed.
Two individual witnesses subscribing to the grantor(s) signature.
Witness
names must be printed below their signatures.
Complete legal description must appear on the deed.
Mailing address of the grantee and preparer's name and
address must
appear on the face of the deed.
The Recording department does not carry blank forms. These may be obtained through an office supply store, and attorney or a title company.
4. How can I obtain a copy of a recorded instrument?
Copies may be purchased in person or by written request. Copy fees are $1.00 per page for official records up to legal size. Plat copies are $5.00 per page. If certification is requested an additional $2.00 is charged for each instrument certified.
5. Can I pay with a personal check?
Payment may be made with a Business check, cashiers check, money order or cash. Credit Cards are accepted with an additional convenience fee. No personal checks are accepted at this time.
6. What is required for a Declaration of Domicile?
You will need to bring a photo ID with $17.00 cash. A driver's license from out of state is acceptable.

PER FLORIDA STATUTE 695.26
The signature of the grantor(s)
must be notarized and the name and address of each
grantor must be printed below each signature.
Document must be notarized and
the notary's name must be printed below signature.
Deed must have two witnesses
signatures subscribing to the grantor(s) signature and their names must be printed below their signature.
A complete legal description of
the property must appear on the deed.
Mailing address of the grantee
must appear on the face of the deed.
Preparer's name and address must
appear on the face of the deed.
Recording fees are $10.00 for the
first page (single side only) and $8.50 for each additional page of the same
document.
Documentary stamp tax is $.70
per $100.00 or a fraction thereof based on the total consideration of the
conveyance. A minimum doc stamp of $.70 is due if a minimum
consideration is showing on the face of the deed.
Personal checks are not accepted. Business checks, cashiers checks and money orders should be made payable to the Clerk of the Circuit Court.
